Terms of Service

These terms govern your use of the HomeAgent mobile and web application. By creating an account or using the platform, you agree to these Terms of Service.

1. Acceptance of Terms

By accessing or using HomeAgent, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the app immediately. These Terms apply to all users — tenants, landlords, and administrators.

2. What HomeAgent Is

HomeAgent is a listing and connection platform only. We enable landlords to advertise rental properties and tenants to find and contact them. HomeAgent does not own, manage, lease, or rent any property listed on the platform.

HomeAgent is not a party to any rental agreement between a landlord and tenant. We do not collect rent, hold deposits, or mediate disputes beyond content moderation.

3. Account & User Responsibilities

You are responsible for:

Providing accurate, truthful information during registration and onboarding

Keeping your account credentials secure and not sharing them with others

All content and communications sent from your account

Ensuring your listings (if a landlord) are accurate, not misleading, and for genuine rental properties you are authorised to rent

Using the platform in compliance with all applicable local laws and regulations

You must be at least 18 years old to use HomeAgent.

4. Payments & Money — HomeAgent Takes None

HomeAgent does not handle, hold, collect, or facilitate any money. We are not involved in any rent payment, deposit, fee, or token that passes between a landlord and tenant. All financial transactions happen entirely outside the platform, directly between you and the other party.

Because HomeAgent never touches your money, we cannot issue refunds, recover lost funds, or mediate payment disputes. Any money you send is at your own risk.

5. Fraud Protection & Payment Safety

HomeAgent cannot control fraud. While we verify landlord identity where possible, verification does not guarantee a transaction is safe. To protect yourself:

Never pay any money — rent, deposit, or 'holding fee' — before you have physically visited the property and confirmed it exists

Always inspect the property in person before making any payment

Do not send money to a landlord based only on photos, messages, or a phone call

Let someone you trust know where you are going before any property viewing — share your location or the viewing address with a friend or family member

Wherever possible, view the property accompanied rather than alone

Be cautious of landlords who pressure you to pay urgently or who refuse an in-person viewing

Prefer traceable payment methods (bank transfer, mobile money with receipt) over cash, so you have a record of who received the money

If a listing or landlord seems suspicious, use the in-app Report feature and do not send any money

⚠️ Never pay cash for a property you have not personally visited. HomeAgent accepts no responsibility for money lost to fraud or scams conducted outside the platform.

6. Landlord Obligations

As a landlord, you must:

Only list properties you legally own or have written authorisation to rent

Provide accurate rent prices, descriptions, photos, and availability dates

Disclose any known defects or issues with the property

Comply with all applicable tenancy and rent control laws in your jurisdiction (see Section 8)

Not discriminate against tenants on the basis of race, gender, religion, nationality, disability, or any other protected characteristic

Not collect fees or advances beyond what is permitted by local law

Respond to tenant inquiries and remove listings promptly once a property is rented

5. Tenant Obligations

As a tenant, you must:

Provide truthful information when contacting landlords

Not misrepresent your identity or intentions

Use in-app messaging responsibly and not harass, threaten, or spam landlords or other users

Understand that HomeAgent does not verify properties and you should conduct your own due diligence before making any payment or signing any agreement

Never transfer rent or deposits to a landlord solely through HomeAgent — verify the landlord and property in person before payment

8. Country-Specific Rent & Tenancy Laws

Landlords and tenants must comply with the rental laws of their country and region. Below is a summary of key legal requirements in the main countries served by HomeAgent. This is informational only and not legal advice — always consult local authorities or a legal professional.

🇬🇭 Ghana — Rent Act, 1963 (Act 220) & Rent Control Act, 1986 (PNDCL 138)

Rent advance: Under Ghanaian law, landlords must not demand rent advance exceeding 6 months for residential premises. Tenants may report violations to the Rent Control Division of the Ministry of Works and Housing.

Tenancy agreements: Rent agreement should be documented in writing. Both parties should retain a signed copy.

Rent recovery: Unlawful eviction is prohibited. Landlords must follow legal procedures through the Rent Control Court for recovery of possession.

Disputes: Rent disputes are resolved through the Rent Control Division or Rent Magistrate Courts. Contact your regional Rent Control office to report any violations.

🇳🇬 Nigeria — Tenancy Laws (State-Specific)

Lagos State: Governed by the Lagos State Tenancy Law (2011). Landlords should not demand more than 1 year's rent in advance from a new tenant, and not more than 6 months from a sitting tenant.

Other states: Tenancy laws vary. Many states limit rent advances. Check your state's Tenancy Law or Recovery of Premises Act.

Eviction: Self-help eviction is illegal. Landlords must obtain a court order (Notice to Quit → court summons) before recovering possession.

Disputes: Resolved through Magistrate Courts or the Rent Tribunal where available.

🇰🇪 Kenya — Landlord & Tenant Act & Rent Restriction Act

Residential tenancies: Governed by the Rent Restriction Act for controlled tenancies. Rent may be paid monthly or quarterly as agreed.

Notice: A landlord must give reasonable notice (typically 2–3 months) before terminating a tenancy or increasing rent.

Disputes: Handled by the Business Premises Rent Tribunal or Rent Restriction Tribunal.

Deposit: A security deposit is permitted; it must be refunded at the end of the tenancy minus any lawful deductions.

🇿🇦 South Africa — Rental Housing Act (No. 50 of 1999) & Consumer Protection Act

Lease: A written lease is required. It must state the rent, deposit, and terms clearly.

Deposit: May not exceed an amount equivalent to 2 months' rent. Must be held in an interest-bearing account and returned with interest within 7–14 days of the lease ending, less lawful deductions.

Notice: Either party must give notice as specified in the lease (usually 1 calendar month for monthly tenancies).

Disputes: Resolved through the Rental Housing Tribunal, which is free and accessible to both tenants and landlords.

Unfair practices: Unlawful eviction, harassment, and unreasonable rent increases are prohibited under the Prevention of Illegal Eviction Act (PIE Act).

Other Countries (UK, Canada, USA, UAE, etc.)

General: Landlords and tenants must comply with the residential tenancy laws of their country, state/province, or city. This includes requirements for written leases, allowable deposits, rent increase limits, and lawful eviction procedures.

Best practice: Always sign a written tenancy agreement, inspect the property before and after tenancy, and keep records of all payments and communications.

9. Prohibited Activities

Users must not:

Post fake, duplicate, or misleading property listings

List a property you do not own or are not authorised to rent

Use the platform for any illegal or fraudulent purpose

Charge or attempt to charge fees beyond what is permitted by local rent laws

Harass, threaten, or impersonate other users

Attempt to circumvent the platform to avoid fees or moderation (e.g. sharing off-platform payment links to evade verification)

Scrape, copy, or redistribute property data or user information without permission

Infringe on the intellectual property or privacy rights of others

10. Landlord Verification

Landlords may voluntarily upload identification documents for verification. A Verified badge indicates that HomeAgent has reviewed the submitted ID — it does not guarantee the legitimacy of any listing or transaction. Tenants should still conduct their own due diligence.

HomeAgent reserves the right to revoke verification status at any time and to remove listings that violate these Terms.

11. No Warranties & Disclaimers

HomeAgent is provided "as is" and "as available" without warranties of any kind — express or implied. We do not guarantee that listings are accurate, complete, or current, or that any transaction will be completed successfully.

Users are solely responsible for verifying property conditions, landlord identity, lease terms, and the legality of any rent or deposit before making a payment or signing a contract.

12. Limitation of Liability

To the maximum extent permitted by law, HomeAgent and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from — or in connection with — your use of the platform, including losses from fraudulent listings, disputed rental agreements, or unpaid rent.

HomeAgent is not liable for the conduct of any user or the outcome of any landlord-tenant relationship formed through the platform.

13. Reporting & Moderation

You can report suspicious listings, fraudulent users, or inappropriate messages through the in-app Report feature. Our admin team will review reports and may suspend or remove accounts that violate these Terms.

HomeAgent reserves the right to remove any listing, suspend any account, or restrict access to the platform at our discretion, with or without notice.

14. Termination

You may delete your account at any time (see Privacy Policy, Section 7). HomeAgent may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the platform.

15. Changes to These Terms

We may update these Terms periodically. When we make significant changes, we will update the "Last updated" date and, where appropriate, notify you via email or in-app notice. Continued use of HomeAgent after changes are posted constitutes your acceptance of the updated Terms.
